Workers’ Compensation by State
State-by-state reference for US general contractors verifying subcontractor Workers’ Comp coverage.
Monopolistic Workers’ Comp states
In these four states, Workers’ Comp insurance must be purchased from a state-run fund. Private carriers cannot write WC in these states. Verify coverage through each state’s online portal rather than through a standard ACORD 25 Certificate of Insurance, because the COI’s WC line will typically be blank.
Competitive Workers’ Comp states
In the remaining states, Workers’ Comp insurance is available through private carriers. Verify coverage on a standard ACORD 25 Certificate of Insurance showing the Workers’ Comp and Employer’s Liability line items, with statutory limits and dates covering the project period.
This reference is for general informational use. Workers’ Comp rules vary significantly by state and change over time. Consult a construction insurance broker or attorney for specific coverage and verification requirements in your jurisdiction.
